Please read the following terms and conditions carefully as use of and/or buying from the Premiergardenstore.com (Site) means that you will be bound by them. In certain instances these terms incorporate statements to be found in the Security & Privacy, Payment, Returns & Refunds and Delivery sections of our site.

1. Waiver

Every effort has, is and will be taken to ensure that the information contained in this site is correct and up to date. The information may, however, become incomplete, inaccurate or out of date. To the full extent permitted by law, but subject to the terms and conditions of sale referred to below, we disclaim all warranties and representations (whether implied or expressed) as to the accuracy of any information contained on this Site.

2. Definitions

For the purposes of these Terms and Conditions the following definitions apply.

Contract. The contract for sale by us and purchase of Goods by you.

Goods. The range of garden and homeware products which are available for purchase from this site in accordance with the terms.

3. Use of this Site

The content of this Site is owned by Premiergardenstore.com. You cannot copy, reproduce, modify, distribute, republish, re-sell, display, post or transmit any part of this Site without the permission of Premier Garden Store.

4. Limitation of liability

This Site should only be used for information purposes. Premier Garden store is not liable for any damage or loss that may occur in the use of any of the information contained or advice given in this site except as stated in the terms and conditions of sale (where applicable )and to the extent that such liability cannot be excluded by law. Premier garden store is not responsible for the Site's accuracy or its fitness for a particular purpose or the reliability of the access to this Site.

5. Data protection and privacy

Any details which you provide to us from which we can identify you are held and processed in accordance with our Privacy Policy.

6. Pricing

6.1 All prices quoted are in British pounds (£).

We may refuse to accept an order:

a)        Where goods are out of stock

b)        Full Payment has not been made.

c)        If there has been a pricing error or description error

d)        If you do not meet any eligibility criteria set out in our terms and conditions

e)        Your shipping address is outside of delivery area (unless agreement has been made prior to order placement)


6.2:   Where we charge separately for shipping, the appropriate rates are set out in our pricing structure shown in "delivery information"

6.3:  Should an incorrect price be displayed,Premier Garden Store reserves the right to refuse orders as set out in 6.1a to 6.1e. 

6.4:  All prices quoted by Premier Garden Store are only valid at the time of contract and are exclusive of any other matters unless otherwise agreed and may be changed at any time.

6.5:  Premier Garden Store reserves the right to revise the quoted price in the event of unforeseen and extraordinary expenses.

7. Ordering and stock availability

We aim to display only items that are in stock and which can be dispatched to you quickly. In the rare event that an item is out of stock we will contact you by either phone or email offering to either refund your purchase, or offer an alternative item.

Once your order is placed you will receive a confirmation email.Please note the contract commences upon despatch of the goods.

Premier Garden Store makes no representation as to the goods, items, products or services referred to in, or sold from, this Site as being available or suitable for use.


8.1:  Delivery is deemed to be successful once the products have arrived at the address provided for delivery. 

8.2:  Signatures are not always necessarily required as proof of delivery unless the item is of significant value,in this case we will require a signature.

8.3:  If a signature is required you should check the condition of the item before signing. Should there be any shortages or damages, these must be notified to us (Premier Garden Store) by e-mail – (within 1 working day of delivery).

8.4:  Other products may be left at the recipients address without a signature except where the customer has specified that it must not be left in their absence. If this option is requested, and goods are left unsupervised Premier Garden Store will not accept liability for the goods.

8.5:  Once delivered the responsibility for the product is deemed to be the cardholder’s and any loss or damage to the product is then at your own risk. This is particularly notable when deliveries are made to public/work places. Where the signature of any authorized body is deemed to be proof of delivery, we can not provide compensation for any loss of items once a signature has been taken.

8.6:  The Free delivery (on many products & over £25) offer is available to the vast majority of the United Kingdom (exceptions may apply for delivery to the Scottish Highlands, UK islands and Northern Ireland) however if a delivery will incur an additional shipping fee then we will contact you first in order to confirm that you still wish to continue the order.  Any additional fees due will be charged at cost price. Any items that are described as free delivery are only free delivery for the vast majority of the United Kingdom. We reserve the right to cancel any order where the shipping postcode is not covered by our couriers.

8.7:  Premier Garden Store will not accept any liability for late delivery of the goods and delivery time will not be of the essence of the contract. 

8.8:  Premier Garden Store will not accept liability for non-delivery, where this is caused by circumstances beyond its control. 

9. Cancellation

If you change your mind about your order, you can cancel your order free of charge so long as you do so within 14 days of receipt of goods. You do not have to provide any reason for cancellation. We will cancel any such order without charging you. We can only return your initial payment when we have received the product back in our possession.Please note return postage must be paid by the customer.

9.1 : In addition, all returned / exchanged products (including the boxes) must be in their ORIGINAL CONDITION i.e. NOT USED, and they must be in their ORIGINAL PACKAGING. - DO NOT TAPE UP, OR WRITE ON BOXES. If you are returning an item that you simply didn’t want anymore the item has to be IN NEW CONDITION (TO BE ABLE TO BE RE SOLD). Any damage to goods / boxes, or sign of use may result in a reduced refund to the customer. Goods must also be suitably packaged. Customers are advised to send their return items via MyHermes. It is very much advised that the customer use a tracked service that is covered for the full product value.

9.2 :  Should an item arrive damaged, the customer must inform Premier Garden Store by either calling us or emailing us. This must be done within 1 working day of receiving the item(s), Premier Garden Store will then advise if the customer are to return the goods for exchange (in which case we will advise the most efficient transit method for return and the appropriate cost we will reimburse) or if we are to arrange an exchange via our courier. All damages / defects must be reported within 1 working day from the date of delivery.

10. Warranties

We aim to deliver goods of the highest quality, in the event that a product bought from premier garden store is faulty we will ask that you contact us with a detailed description of how the product is faulty (we may require photos).Premier Garden Store supplies such a large variety of products, Many of which are established brands. Each manufacturer has their own warranty policies this can be seen by looking at the product description or by contacting us by phone or email.

11. Changes to the terms

Premier garden store reserves the right to remove, modify or change, without notice, any information on this Site. If you use the Site after Premier Garden Store has posted the changes you will be bound by the new terms. You should therefore ensure that you read the terms each time you use the Site.

13. Statutory rights

The consumer's contract with Premier garden store does not effect the consumer's statutory rights.

14. Governing law and jurisdiction

These terms and your use of this Site are governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the Courts of England and Wales.
